Privacy Policy

The rest of this page sets out the detail. It is written in plain English on purpose. If anything here is unclear, please ask us and we will explain it.

1. Who we are

This policy is issued by Immersion Engine ("we", "us", "our"), an independent software studio based in Australia, which publishes the products listed at immersionengine.com.au.

For the purposes of the Australian Privacy Act 1988 (Cth) and the EU and UK General Data Protection Regulation, Immersion Engine is the data controller for the information described in this policy.

You can reach us through the contact form on this website. We read every message ourselves.

2. What this policy covers

This policy covers this website, and every piece of software we publish:

• Our Adobe After Effects plugins and panels: AudioDriven, VectorPlex Pro, Kinetic Type, Version Increment Namer, and Generative Art & Edge-Blend
• HeliosSharp, our browser-based solar image processor
• Filmmaker's Viewfinder, which runs in your phone's browser
• The Living Watercolour Engine, which we deploy on commissioned work

Different products behave differently, so each has its own section below. Where a product is not mentioned, nothing in that category applies to it.

3. This website

No tracking, no cookies

This website sets no cookies. It runs no analytics, no advertising scripts, no tracking pixels, no social media widgets and no fingerprinting. It does not use browser local storage. There is no consent banner because there is nothing to consent to.

The site also makes no requests to third-party servers. Fonts, styles, scripts and images are all served from our own domain, so simply reading these pages does not disclose your visit to anyone else.

Server logs

Like virtually every website, our web server records a standard access log entry for each request. A log entry can include your IP address, the date and time, the page requested, the referring page and your browser's user agent string. These logs are generated automatically by our hosting provider's server software.

We use these logs only to keep the site running securely and to diagnose faults. We do not use them to build profiles, and we do not combine them with any other information. Our lawful basis for this processing under the GDPR is our legitimate interest in operating a secure and functioning website.

4. When you contact us

If you use the contact form, we receive the name, email address, subject and message you type into it. That is all the form asks for, and all of it is information you choose to give us.

The form sends your message directly to our own email inbox. It is not handled by a third-party form service, and the message is not written to a database or stored on the web server.

We use this information for one purpose: to reply to you and to deal with whatever you contacted us about. We will not add you to a mailing list, and we will not use your address for marketing. Our lawful basis under the GDPR is our legitimate interest in responding to enquiries, or the performance of a contract where your message relates to a purchase or a commission.

We keep correspondence for as long as it is useful for support, warranty and business records, and then delete it. You may ask us to delete your correspondence at any time.

5. Our After Effects plugins

Your creative work stays on your machine

Our plugins and panels run inside After Effects on your own computer. All processing is local. We never receive your projects, compositions, footage, audio, images, fonts, file names, folder paths or render output. We have no server that could receive them.

Where a plugin needs to read something from your system in order to work, it does so locally and the result stays local. For example, Kinetic Type lists the variable fonts installed on your computer so you can preview and choose one. That list is used only to draw the panel on your screen, and is not transmitted anywhere.

Checking for updates

Our plugins check whether a newer version is available. To do that, the plugin makes a request over the internet, which necessarily discloses your IP address to the server handling it, together with the product and version you are running so that it can be told whether an update exists.

This check is used to tell you that an update is available. It does not carry any information about your projects or your use of the software, and it is not used to build a profile of you. Our lawful basis under the GDPR is our legitimate interest in ensuring users can obtain security and stability fixes.

Licences and activation

Our plugins are licensed software. When you enter or validate a licence, the software transmits your licence key and an identifier derived from your computer to the licensing service that issued that licence, so that it can confirm the licence is genuine and is being used within its terms. Depending on how you obtained the software, that service may also process the email address associated with your purchase.

This is necessary to perform our contract with you: without it we cannot supply licensed software. If you obtained the software through a marketplace, the licensing and payment systems are operated by that marketplace, not by us, and their handling of your information is governed by their own privacy policy. See section 9.

6. HeliosSharp

HeliosSharp runs in your web browser. When you open an image in it, that image is read and processed by your own browser, on your own computer. Your astrophotography is not uploaded to us, and we never see it. Exported files are written by your browser to wherever you choose to save them.

Delivering the application itself involves the ordinary server logs described in section 3.

7. Filmmaker's Viewfinder

The viewfinder runs entirely in your phone's browser. Once the page has loaded it works offline, and it contacts no server of ours and no third party.

Camera and location

The app uses your phone's camera to show a live viewfinder, and can record the location where a reference frame was taken, which is the point of a location-scouting tool. Your phone will ask your permission before either is used, and you can refuse or withdraw that permission at any time in your browser or device settings.

The camera feed is never recorded, transmitted or seen by us. It is drawn on your screen and discarded frame by frame.

What the app stores, and where

Captured frames, your projects and shot lists, and the location data attached to them are stored on your own device by your browser. They are yours. We have no server to receive them and no account for you to create.

If you export a PDF shot report, it is generated on your device and saved wherever you choose. You control where it goes from there, and you should be aware that an exported report may contain the location information it was built from.

Clearing your browser's site data for this website, or uninstalling the app after adding it to your home screen, deletes everything the app has stored.

An earlier version of this app offered an AI-assisted camera lookup that sent queries to Google. That feature was removed before the app was published here, and no version available on this website has ever contacted an AI service.

8. Living Watercolour Engine

This engine is used on commissioned work rather than distributed as a product. It renders artwork and does not collect personal information from anyone viewing that artwork. Where a commission involves a client relationship, the information we hold is ordinary business correspondence, covered by section 4.

9. Marketplaces and other third parties

If you obtain our software through a distribution platform such as the Adobe Exchange, Adobe Creative Cloud, an app store or a plugin marketplace, then the purchase, the account and the payment are handled by that platform, not by us. We never see or receive your payment card details. Those platforms are independent controllers of the information they collect, and you should read their privacy policies.

Depending on the platform, we may be given aggregate sales reporting, and occasionally limited order details such as a name or email address in order to provide support or fulfil a licence. We use such information only for those purposes.

We do not use advertising networks, data brokers or analytics providers. We do not sell or share personal information, including as those terms are defined under the California Consumer Privacy Act, and we have not done so in the preceding twelve months.

10. Children

Our products are professional creative tools intended for adults. They are not directed at children, and we do not knowingly collect personal information from a child under 16. If you believe a child has provided us with personal information, please contact us and we will delete it.

11. Where information is held, and for how long

Our website is hosted in Australia. Correspondence you send us is held in our email system. If you are contacting us from outside Australia, your message will necessarily be transferred to Australia, and where information passes to a third party such as a marketplace or Google, it may be processed in other countries. Where the GDPR applies, we rely on appropriate safeguards for such transfers, including the European Commission's standard contractual clauses as implemented by those providers.

We keep personal information only for as long as we need it for the purpose it was collected, or for as long as the law requires us to keep business records, and then we delete it. Server logs are retained for a short period by our hosting provider and then rotated out.

12. Security

The whole site is served over HTTPS, so traffic between you and us is encrypted in transit. We deliberately hold as little information as possible, which is the most effective protection there is: information we never collected cannot be exposed. Access to our systems is limited to us.

No method of transmission or storage is perfectly secure, and we cannot guarantee absolute security. If a data breach occurs that is likely to result in serious harm, we will notify affected individuals and the relevant regulator as required by the Notifiable Data Breaches scheme and any other applicable law.

13. Your rights

You have the right to ask us:

• whether we hold any personal information about you, and to be given a copy of it
• to correct anything that is inaccurate or out of date
• to delete information we no longer have a good reason to keep
• to restrict or object to a particular use of it
• to provide it in a portable, machine-readable form, where that right applies
• to withdraw a consent you previously gave, at any time

Depending on where you live, these rights arise under the Australian Privacy Principles, the GDPR, the UK GDPR, or laws such as the California Consumer Privacy Act. We apply them to everyone regardless of where you are, because it is simpler and fairer than doing otherwise.

To exercise any of them, contact us through the contact form. We will respond within 30 days. We will not charge you, and we will not treat you differently for asking.

14. Complaints

If you are unhappy with how we have handled your personal information, please tell us first through the contact form so we have a chance to put it right.

If you are not satisfied with our response, you can complain to a regulator. In Australia that is the Office of the Australian Information Commissioner at oaic.gov.au. If you are in the European Economic Area or the United Kingdom, you may complain to your national data protection authority.

15. Changes to this policy

If we change what we do with personal information, we will update this page and change the date at the top. Where a change is significant, we will say so clearly rather than leaving you to spot it. Previous versions are available on request.
